All thanks and praises are due to Allah, whom we thank, seek help and invoke for forgiveness. We seek refuge with Allah from the evils within ourselves. He whom Allah guides will never be misled and he whom He misguides will never find one to guide him. I bear witness that there is no deity worthy of worship except Allah and that Muhammad is his slave and Messenger.
Allah says
“ O’ you who have believed, keep your duty to Allah and shield yourself from His wrath, and speak (always) the truth.He will direct you to do righteous good deeds and will forgive you your sins. And whosoever obeys Allah and His messenger (SAW), he has indeed achieved a great achievement” [al-Ahzab 70-71]
“Ask the people of knowledge if you know not” [an-Nahl 43]
“Follow not which you have no knowledge of…” [Al-isra’ 36]
Narrated by Jabir Bin ‘Abdullah that he said, “We went on a journey and man from amongst us was injured in the head by a stone. After this he had a wet dream. He asked his companions, ‘ do you find that I have concession for performing tayammum?’
They said, ‘We do not find any concession, for you are capable of employing water (for purification).So he bathed and as a result died. When we returned to the Prophet SAW he was informed of this upon which he said “They have killed him, May Allah kill them! Could they not have asked if they did not know? Indeed The cure of ignorance is to ask! It was sufficient for him to perform tayammum, sprinkle some water on the wound or put a bandage on his wound and then wipe over it , and wash the reminder of the body.[Sunan Aboo Dawood English translation 1/89 no.336]
[Da’eef]
This hadith is a da’eef hadith (da’eef isnaad) but is strengthen by another hadith narrated by Ibn Abbas reported in sunan ibn majah volume 1 hadith no.572 .
It was narrated that ‘Ata’ Bin Abu Rabah said : “ I heard Ibn Abbas saying that a man was injured in the head at the time of the Messenger of Allah (SAW), then he had a wet dream. He was told to take a bath, so he took the bath, become rigid and stiff, and died. News of that reached the Messenger of Allah (SAW) and he said : “They have killed him, May Allah kill them! Is not the cure for lack of knowledge to ask Questions? [Sahih part]
Ata’ said: “ we heard that the Messenger of Allah said: ‘If only he had washed his body and left his head alone where the wound was” [Da’eef part]
This raises the hadith to the level of Hassan. Thus this hadith is Hassan li ghairihi.
But the part “ sprinkle some water on the wound” remains da’eef. (For further reading - usool al-hadeeth : The methodology of hadith evaluation by Dr. Ameenah Bilal Philips pg.60-91)
Brothers and sisters,
In accordance with a fiqh principle:-
“Everything regarding ta’ubudiyyah (worshipping ) is not permissible (haram) unless there isenough evidence (from Quran and authentic sunnah) that permits it. Everything that Allah created is permissible (halal and mubah) unless there is enough evidence that prohibits it” [Halal wal Haram in Islam pg. 14]
Issuance of fatwa (Islamic verdict, what is halal and haram to do, is it permissible or not permissible etc) demands extreme caution. While issuing a ruling, it is one of the imperatives to give due consideration to the situation of the questioner.[ commentary sunan ibn majah]
If the question asked has no easy answer, it is best to avoid giving the answer, and advice the questioner to refer the matter to a higher authority on Islamic jurisprudence.[ commentary sunan ibn majah]
Issuing an opinion on Islamic matters is not an easy task. But some of us, may be because of our ignorant, easily utter these sentences when we were asked about our stand in certain Islamic issues
